Nothing in these Terms affects your statutory rights.
1. Introduction
For the purpose of these Terms, “we”, “us” and “our” refers to Xtreme Tactical Ltd. “You” and “your” refers to the customer, website visitor, account holder or person placing an order.
By accessing our website, creating an account, placing an order or purchasing from us, you agree to these Terms.
These Terms should be read together with our Shipping Policy, Returns & Refunds Policy, Privacy Policy, Cookie Policy, Legal Notice and any other policies published on our website.
2. Use of Our Website
You may use our website only for lawful purposes.
You must not:
- submit false, misleading, incomplete or fraudulent information;
- attempt to access our systems, accounts, payment systems or customer data without permission;
- interfere with the security, performance or operation of our website;
- copy, scrape, reproduce or misuse our product descriptions, images, branding, content or website layout;
- use our website or products for unlawful, unsafe, restricted or prohibited purposes;
- place orders for any person, destination, business or end use that is prohibited by law.
We reserve the right to restrict, suspend or terminate access to our website where we believe these Terms have been breached.
3. Customer Eligibility
By placing an order with Xtreme Tactical Ltd, you confirm that:
- you are legally capable of entering into a binding contract;
- you are at least 18 years old, unless a higher age requirement applies in your location;
- all information provided by you is accurate, complete and up to date;
- you are purchasing for lawful civilian, sporting, professional, collection, repair, replacement, training or other lawful use only;
- you are not prohibited from purchasing, possessing, importing, exporting, transferring, reselling or using the products ordered;
- you are not located in, acting for, supplying to or purchasing on behalf of any sanctioned, restricted or prohibited person, organisation, country or territory.
We may refuse, hold or cancel an order where identity, payment, address, age, product eligibility, fraud, sanctions, export, lawful-use or compliance checks are required.
4. Product Information
We aim to keep product listings accurate, clear and manufacturer-aligned.
Product information may include brand, model, SKU, MPN, UPC, reticle, finish, illumination, mount type, compatibility, accessories, specifications, warranty details, product images and availability.
However, errors, manufacturer changes, supplier updates, packaging changes, image variations or typographical mistakes may occur.
Product images are for guidance only unless stated otherwise. Packaging, finish, accessories, markings, labels, included parts and presentation may vary depending on manufacturer batch, model version or region.
Where a manufacturer part number, SKU, MPN or UPC is provided, that identifier should be treated as the primary product reference.
You are responsible for checking product suitability before purchase. This includes checking fitment, mounting compatibility, platform compatibility, reticle, colour, battery type, legal requirements and intended use.
We reserve the right to correct errors, update product information, amend prices, remove products or cancel orders affected by obvious mistakes.
5. Orders and Contract Formation
Placing an order is an offer to purchase the selected goods.
After placing an order, you may receive an order confirmation email. This confirms that we have received your order, but it does not mean the order has been accepted.
A binding contract is formed only when we accept your order and dispatch the goods, or when we otherwise confirm acceptance in writing.
We may refuse, hold or cancel an order before dispatch if:
- the product is unavailable;
- payment has not been authorised;
- payment appears fraudulent, suspicious or high risk;
- billing or delivery details cannot be verified;
- product information, stock or pricing contains an error;
- the order appears inconsistent with lawful personal, sporting, professional or business use;
- the product is restricted for the destination;
- legal, fraud, sanctions, customs, export or compliance checks cannot be completed;
- we reasonably believe the order may breach these Terms or applicable law.
If we cancel an order after payment has been taken, we will refund the cancelled item unless we are legally required to delay or withhold payment due to fraud, sanctions, chargeback, law enforcement or regulatory reasons.
6. Prices, VAT and Payment
Prices are shown in the currency displayed on our website.
For UK customers, prices include VAT where VAT is applicable unless stated otherwise.
We accept the payment methods shown at checkout. Payment must be authorised before an order is processed.
You must not use a payment card, account or payment method that you are not authorised to use.
We reserve the right to carry out payment checks, fraud checks, address checks and order verification before accepting or dispatching an order.
7. UK Warehouse and No UK Import Fees
Xtreme Tactical Ltd ships from a UK warehouse.
For UK customers, this means there are no import duties, no customs clearance fees and no unexpected overseas import charges on delivery.
The price shown at checkout, together with any selected delivery charge, is the relevant charge for UK customers unless otherwise stated.
8. Restricted Products, Legal Use and Export Compliance
Some products sold by Xtreme Tactical Ltd may be subject to age restrictions, export controls, import controls, sanctions rules, carrier restrictions, local possession laws, customs rules or end-use restrictions.
By placing an order, you confirm that:
- you will use the products only for lawful purposes;
- you will not export, re-export, transfer, resell, divert or supply products in breach of UK, US, EU, UN or other applicable laws;
- you will not supply products to any sanctioned party, prohibited destination, restricted entity, unlawful end user or prohibited end use;
- you will obtain any licence, permit, approval or authorisation required in your jurisdiction;
- you will not misrepresent the purchaser, delivery address, end user, destination, resale route or intended use.
We may hold, cancel or refund any order where legal, regulatory, export, sanctions, safety, fraud, diversion or lawful-use concerns apply.
9. Product Safety and Installation
You are responsible for using all products safely, lawfully and in accordance with manufacturer instructions.
Optics, mounts, screws, batteries, chargers, switches, lights and accessories must be installed, inspected, maintained and used correctly.
We are not responsible for injury, loss, damage, legal consequences, equipment failure, zero shift or product damage caused by misuse, incorrect installation, incompatible equipment, unlawful use, unauthorised modification, improper charging, unsafe handling or failure to follow instructions.
If you are unsure whether a product is suitable for your intended use, seek appropriate professional advice before purchase or use.
10. Manufacturer Warranties
Some products may be supplied with a manufacturer warranty.
Manufacturer warranties are provided by the manufacturer, not by Xtreme Tactical Ltd, unless we expressly state otherwise.
We may assist by providing order information or directing you to the manufacturer’s warranty process, but we do not control the manufacturer’s decision, warranty coverage, repair process, replacement approval, timescale or outcome.
Manufacturer warranties do not replace your statutory rights.
Damage caused by misuse, incorrect installation, improper mounting, modification, unauthorised repair, accidental damage, exposure to unsuitable conditions, normal wear and tear, unlawful use or failure to follow manufacturer instructions may not be covered.
11. Business Customers
If you purchase as a business, reseller, trader, organisation or professional user, you confirm that you have authority to bind that business.
Business customers are responsible for product suitability, technical compatibility, resale legality, export compliance, end-user compliance and local legal requirements.
Consumer cancellation rights may not apply to business purchases.
12. Reviews and User Content
If you submit a review, image, message, comment or other content, you confirm that it is accurate, lawful and does not infringe third-party rights.
We may remove or refuse to publish content that is abusive, false, misleading, unlawful, defamatory, offensive, irrelevant, promotional or spam.
By submitting content, you grant us permission to use, display, reproduce and share that content for website, marketing, customer service and business purposes, unless you tell us otherwise in writing.
13. Intellectual Property
All website content belongs to Xtreme Tactical Ltd, our licensors or the relevant rights holders unless stated otherwise.
This includes logos, branding, product descriptions, collection content, images, graphics, banners, layout, text, icons, videos, listing formats and website design.
You must not copy, reproduce, distribute, scrape, modify, sell, publish or commercially exploit any website content without our prior written permission.
Manufacturer names, product names, trademarks and logos belong to their respective owners and are used for product identification and description only.
14. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
Subject to that, Xtreme Tactical Ltd is not responsible for:
- indirect or consequential loss;
- loss of profit, revenue, business, goodwill or opportunity;
- delays outside our reasonable control;
- carrier delays, customs delays or supplier delays;
- misuse, incorrect installation or unlawful use of products;
- customer failure to check compatibility or legal restrictions;
- import refusals, seizures or restricted-product issues outside our control;
- website downtime or third-party service failures;
- loss caused by inaccurate information supplied by you.
If you are a business customer, our total liability for any claim relating to an order will not exceed the price paid for the goods giving rise to the claim, except where liability cannot legally be limited.
15. Chargebacks and Payment Disputes
If you have an issue with an order, contact us first so we can try to resolve it.
Where a chargeback, payment dispute or payment reversal is opened, we may provide evidence to the payment provider, including order details, tracking, delivery confirmation, correspondence, verification records and proof of dispatch.
False or dishonest payment disputes may result in account closure, cancellation of future orders and recovery of reasonable costs where permitted by law.
16. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer living in another part of the United Kingdom, you may also have rights to bring a claim in your local courts.
If you are a business customer, the courts of England and Wales will have exclusive jurisdiction unless we agree otherwise in writing.
